The $37 million lawsuit against DJs - justified or greed gone too far?

What do you think of the $37 million lawsuit slapped on David Jones and ex-CEO Mark McInnes for sexual harassment?

It's unlikely former David Jones publicist Kristy Fraser-Kirk will receive anywhere near this amount if she wins (she said that the money will go to charities fighting sexual harassment). But is this a case of greed gone too far? Does it deflect from the case itself and that of other women facing a similar situation in their workplace, or is this huge amount justified because large organisations need to be taught a lesson?

I was in the DJ'S carpark last week and had my car extensively scratched and expletives gouged across the paintwork of my car... by another driver...that i had parked next to, on my passenger side...GRRRRRRR!
Driving a ve commodore leaves you little room each side and i parked next to a ford territory -even larger and wider than my car... and little room to open doors-hence no room to manoeuvre comfortably-and this is what the jerk did to my car...absolutely livid i was.
The carpark's reply when i rang-you enter the property at your own risk, no recourse of any kind, we don't cover what happens within our premises if your car is damaged.
How many other drivers have been in this position with damage to their cars and the car parks accept no responsibility.
Consequently I hate David Jones so I feel this is karma LOL-the $37million lawsuit, but if they don't care about customers who park in their car parks, then what chances will the former employee have-
David Jones are about their board members and share holders and profits-I wont be shopping with them again-give me Myer anyday

I have to say I think it's a little much, considering the crime and the fact that so many others in her position don't get a cent. It's nice that she says it'll go to charity and if it does, it's probably better off feeding a couple of hundred kids in Africa than in DJ's pocket. Not really sure whether I'm for it or against.

The lawsuit is justifiable given the evidence to date. Sexual harrassment is not a mistake as the perpetrator gives reason to. Sexual harrassment is an action with purpose and inexcusable period!
DJ management had received a report and with the board turned a blind eye to the behaviour why???....the perpetrator made money for the company. The fact more cases are surfacing reinforces the legitimate rights challenging companies to take action throughout Australia.

Questions surrounding why other people did not take action remain with them although these thoughts come to mind....maturity, fear, belief, judgement, possible unemployment.

Harrassment claims are factual based and seeking punitive damages in my view supports a deterrent effect for anyone attempting to inflict this type of behaviour!

How interesting DJ's hoped a quiet settlement would resolve all when that failed they removed the perpetrator in an attempt to minimise brand damage, the perpetrator hired a company to deflect his behaviour then made off overseas with his pregnant partner to save face it did no more than raise more media attention while Dj's brought forward their fashion parade to distract publicity another bad move.

This employee deserves support and the money to work through the counselling required to ensure her health & wellbeing are never compromised again giving this person the opportunity to start a new life!

I think $37 million is an insane amount of money to be claiming. I believe this whole case is based on greed. Don't get me wrong she is entitled to something but $37 million, c'mon!

The figure reached would have been one that Kristy's lawyers would have advised her on...don't forget that Mark was a CEO of a National Company and he would be made accountable for his actions...yes a precedent!
Other women have now come forward since Kristy went public and no doubt people will question the amount.
The thing to remember is, that besides damages both personally and professionally which Kristy has had to bear, the amount will never be known, i dare say if David Jones pays out there will be a clause where she can't divulge the amount publicly.
Incidentally, to suffer any kind of abuse in the work place is not on...but being sexual abuse by a colleague who is male and your superior would have been extremely difficult to contend with, in her trying to carry out her job ...as well as keep it!
